Boudoir Service Contract
This Contract is between the “Client” and Living Goddess Boudoir (the “Photographer”)
The Contract is dated [the date that both parties sign]
1. WORK AND PAYMENT
a. Project. The Client is hiring the Photographer to do the following: Boudoir Photography and Intimate Photography services.
b. Schedule. The Photographer will begin work on the date specified below, under “Session Date”. This contract can be cancelled by either the Client or the Photographer at any time, pursuant to the terms that the Session Fee/Booking Deposit paid by the Client is nonrefundable upon this cancellation.
c. Payment. The Client will pay the amount that reflects the project chosen with The Photographer (in USD) as a Session Fee. Of this, The Client will then choose their Products previous to the session and pay for the Collection they so choose. The Collection the Client chooses will be put on a Prepayment Plan that must be started within 30 days of booking and paid 30 days previous to the session date. The total that the Client will pay the Photographer will be logged through Invoices sent by the Photographer. Once a Collection is chosen and paid for, it becomes a nonrefundable product (as all images and products are chosen by the Client).
d. Invoices. The Photographer will invoice the Client. The Client agrees to pay the first payment amount owed (if on a prepayment plan) 30 days within receiving the invoice. The Client agrees to pay the total amount 30 days previous to the photography session. Lack of payment after this duration will incur a project cancellation, and all payments will become a nonrefundable - the Client agrees to forfeit their session fee.
e. Cancellation/Rescheduling. In the occurrence that The Client must cancel or reschedule the session, they will be charged a cancellation/rescheduling fee of $500 (USD). In the occurrence that The Client does not cancel/reschedule their session but does not show for their session or misses three invoices previous to their session, their Collection becomes a nonrefundable Product, and the Client agrees to forfeit their session fee.
2. OWNERSHIP AND LICENSES
a. Client Owns All Work Product. As a part of this job, the Photographer is creating “finished product (or finished goods)” for the Client. The Photographer hereby gives the Client this finished product once the client pays for it in full. This means that the Photographer is giving the Client all its rights, titles, and interests in the finished product (including the intellectual property rights), and the Client will be the sole owner of it. The Client can use the finished product however they would like or not at all.
b. Photographer’s Use of Finished Product. Once the Photographer gives the finished product to the Client, the Photographer does not have rights to it, except those that the Client explicitly gives the Photographer here. The Client gives the Photographer permission to us the finished product as a part of the Photographer’s portfolio, and websites in galleries and other media so long as it highlights the Photographer’s work and not for any other purpose (ONLY IF The Client signs a Model Release Form). The Photographer is not allowed to sell or otherwise use the finished product to make money for any other commercial use. The Client is not allowed to take back this license, not even after the contracted has ended.
DEFINITIONS:
“Final Product (or final goods)” - goods that have completed required manufacturing process and are ready to be fitted/mixed/processed with final product. The final product itself could also be called finished goods.
“Invoice” - a list of goods sent, or services provided, with a statement of the sum due for these. A bill.
“Intellectual Property Rights” – the rights given to persons over the creation of their minds.
“Session Fee” - the fee a photographer charges for the service of taking photos.
Everything included in session fee:
1. A Pre-shoot consultation
2. Wardrobe and styling advice
3. Full access to the Client Wardrobe in sizes XS - 4X
4. Expert posing and guidance throughout the session
5. Professional Hair and Makeup
6. A one-hour photoshoot
7. Professional retouching of all final images
I am a legally competent adult and have the right to contract in my own name. I have read this document and fully understand its contents, meanings, and implications. This Contract shall be binding through the electronic signature.
I understand that upon cancellation of Contract, before the project has begun, the Session/Booking Fee is nonrefundable. All parties agree to the fees stated above and hereby accept the amounts charged.
